Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your use of the LeafMeGrow mobile app ("App") and the website at leafmegrow.com ("Website"). By downloading or using the App, or by accessing the Website or joining the waitlist, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the App or the Website.

These Terms are an agreement between you and Ian Dirk Louw, sole trader (empresário em nome individual) registered in Portugal, trading as Octara Labs, of Rua Fernando Gil Cardeira 2, 1 Esq, 8800-082 Conceição de Tavira, Portugal, VAT ID PT333624769. Full provider details are in our Imprint.

2. Eligibility and Age Restrictions

You must be 13 or older to create a LeafMeGrow account or to join the waitlist. By using either, you confirm that you meet that age.

Some countries set a higher age — up to 16 — before a young person can consent to the use of their data for services like ours. If you are under 16, please ask a parent or guardian before using the features that rely on your consent: location, weather, notifications and camera access. Where local law requires it, we rely on their permission rather than yours.

3. What LeafMeGrow Provides

The App is a gardening companion that offers:

• Personalised planting calendars based on your USDA growing zone
• Growing-zone detection using your device location
• A plant database with care guides and growing information
• Personal garden management with care schedules, reminders and photo journals
• Weather forecasts and weather-aware care adjustments
• Assisted plant identification from your photos
• Disease and pest reference information
• Frost date estimates and seasonal growing recommendations

The App is provided for informational and planning purposes. Section 8 sets out important disclaimers about the accuracy of plant care recommendations.

4. Your Account

• You must provide an accurate email address to create an account.
• You are responsible for maintaining the security of your credentials. Do not share your password.
• One account per person. Creating multiple accounts to circumvent restrictions is not permitted.
• You are responsible for all activity that occurs under your account.

5. Waitlist

By submitting your email address to join the waitlist you are asking to be notified about LeafMeGrow. Joining the waitlist does not guarantee access, a specific launch date, or any particular feature set. We may manage waitlist membership at our discretion. You may remove yourself at any time by emailing privacy@leafmegrow.com.

6. Your Content

The App lets you upload photos and write journal entries, plant notes and care records ("Your Content").

• This version is private by default. LeafMeGrow does not currently include community, social or messaging features. Your Content is stored for your own use and is not published to other users.
• Your ownership. You retain all rights to Your Content. You grant us a non-exclusive, worldwide, royalty-free licence to host and store it only as needed to operate the App for you.
• Your responsibility. You are solely responsible for Your Content. Upload only content you have the right to use.
• Moderation. We may remove content that violates these Terms, and may suspend or terminate accounts for serious or repeated violations.
• Removal on deletion. Deleting your account removes Your Content from our systems. See the Privacy Policy for the retention schedule.

7. Acceptable Use

When using the App or the Website, you agree not to:

• Use either for any unlawful purpose, or in a way that violates applicable laws or regulations
• Attempt unauthorised access to our servers, databases, systems or networks
• Use automated bots, scrapers or crawlers to extract data from the App, the Website or our API without written consent
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the App
• Use the App or Website in any manner that could damage, disable or impair our infrastructure
• Impersonate any person or entity, or misrepresent your affiliation with one
• Harass, threaten or intimidate other users
• Transmit content that is unlawful, hateful, sexually explicit, violent or otherwise objectionable

8. Gardening Advice Disclaimer

We do not guarantee:

• Crop yields or growing outcomes from following App recommendations
• The accuracy of frost date predictions or USDA zone calculations
• That plants grown using our guidance will survive, thrive, or produce at expected levels
• The completeness or accuracy of disease identification or treatment information

LeafMeGrow is not a substitute for professional horticultural or agricultural advice. For commercially critical growing decisions, consult a qualified agronomist or extension service in your area. You rely on this information at your own risk.

9. No Warranty

The App and Website are provided on an "as is" and "as available" basis without representations or warranties, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App or Website will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by Portuguese law, LeafMeGrow shall not be liable for crop loss, plant death, garden damage or other agricultural outcomes arising from following App recommendations, nor for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of or inability to use the App or Website.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed €100. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded by law.

11. Intellectual Property

The LeafMeGrow App and Website — including the name, logo, visual design, copy, illustrations, plant database, growing data and underlying code — are the intellectual property of LeafMeGrow and its licensors, protected by copyright, trade mark and other applicable laws.

• You may use the App for your personal, non-commercial gardening purposes.
• You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the App or Website without our prior written permission.
• You may not use our name, logo or brand assets without prior written consent.

12. Indemnification

You agree to indemnify, defend and hold harmless LeafMeGrow and its officers, directors, employees and agents from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your use of the App or Website, your violation of these Terms, or your violation of any third-party rights.

13. Third-Party Links and Services

The App and Website may link to or rely on third-party websites and services. These are provided for your convenience and to operate the product. We do not control and are not responsible for the content, privacy practices or availability of any third party. Accessing third-party sites is at your own risk. The third parties we rely on are listed in our Privacy Policy.

14. Privacy and Data Processing

Your use of the App and Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our use of cookies is governed by our Cookie Policy. By using the App or Website you acknowledge that you have read and understood both.

15. Termination and Account Deletion

Either party may end this agreement at any time.

• By you. Delete your account in the App, or follow the instructions at leafmegrow.com/delete-account. On deletion, your account data is removed from our systems.
• By us. We may suspend or terminate your account if you violate these Terms, attempt to harm other users or our systems, or engage in fraudulent activity, or if required to do so by law. We will make reasonable efforts to notify you first, except in cases of serious violation.

Sections 8, 9, 10, 11, 12 and 17 survive termination.

16. Changes to These Terms

We may update or modify these Terms at any time. When we make material changes we will update the effective date at the top of this page and, where appropriate, notify users in the App or waitlist members by email. Your continued use after any change constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by Portuguese law, because that is where the operator is established. Disputes may be brought before the courts of Portugal.

If you are a consumer, this choice does not deprive you of the protection of the mandatory consumer law of the country where you live. If you are a consumer resident in the EU, you may also bring proceedings in the courts of your own country, and we will only sue you there. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable from the remaining provisions, which continue to be valid and enforceable to the fullest extent permitted by law.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LeafMeGrow with respect to the App and the Website, and supersede all prior communications and proposals.
